Hard Rock Digital Faces Class Action Lawsuit Over “No Regret First Bet” Promotion
Hard Rock Digital, owned by the Seminole Tribe, is currently entangled in a federal class action lawsuit filed in the Middle District of Florida. The plaintiff, Brandon Montgomery, accuses the company of deceptive and misleading advertising practices related to its “No Regret First Bet” promotional offer, which purportedly provides “risk-free” bets for new users.

Controversial “Risk-Free” Promotion
The lawsuit highlights that “risk-free” promotions have a history of causing legal disputes, with this case bearing similarities to previous actions against major gambling entities like DraftKings.
According to the lawsuit, Hard Rock Digital’s promotion misleads users into believing they are not financially impacted if they lose their first bet.
However, the reality, as alleged, is that users are required to wager real money initially, and any bonus funds received after a loss must be wagered again to convert them back into actual dollars.
This condition, the lawsuit claims, effectively reduces the value of the bonus by half, as users do not recover their initial stake.
Financial Impact on Users
Montgomery’s lawsuit contends that the promotion’s structure leaves users in a worse financial position, contrary to the “No Regret” messaging. The legal complaint, filed under Florida Statutes, Chapter 501, aims to represent Montgomery and other affected users.
It argues that although the fine print of the promotion discloses the mechanics, these details contradict the overarching promise of a “risk-free” bet, ultimately leading to significant financial losses and frustration for users.
The lawsuit further alleges that the promotion was designed to encourage new users to make riskier bets, such as parlays or bets with higher odds, during their initial use of the app.
