NYC Planning Commission Proposes Zoning Amendment to Facilitate Casino Development
The New York City Planning Commission has initiated a seven-month process to amend zoning texts, potentially paving the way for legalizing casinos in designated commercial and manufacturing areas across the city’s boroughs.
The proposed amendment aims to streamline the process for establishing casinos by bypassing the Uniform Land Use Review Procedure. This change would mean that casinos in these zones would only require state licensing and Community Advisory Committee approval.

Dan Garodnick, CPC chair and DCP director, emphasized the need to create a fair competitive environment for New York City casino applicants: “”As the state considers proposals for casinos downstate, it’s important that we create a level playing field for applicants within New York City so they can compete for this opportunity” said Garodnick, according to Commercial Observer.
Impact on Land Use Applications
This initiative is also designed to prevent an influx of individual land use applications from casino bidders. The licensing process mandates local land use approvals prior to state gaming commission consideration.
Zoning and Compliance Specifications
Under the amendment, gaming facilities with a state license would be considered compliant with zoning regulations in specified commercial and manufacturing zones. This also extends to non-casino uses like hotels, restaurants, and bars, which would be deemed in compliance with the Zoning Resolution.

The proposal could benefit developers vying for one of the three downstate licenses from the New York State Gaming Commission. Notable proposals like those from Related Companies and Wynn Resorts in Hudson Yards, Thor Equities in Coney Island, and Stefan Soloviev’s Freedom Plaza align well with the zoning classifications under the new proposal.
Now the amendment will undergo review by the city’s 59 community boards and five borough presidents, with a Council vote expected next year.
